Is Avci going to prison again?

The navy officer, Yasin Türker, who stood trial in the Balyoz case, whose part of his life had been stolen because of that, who is one of the victims of document forgery, was asking the following in one of his messages;


“What’s your prediction about how we will get out of all this lawlessness? Isn’t the criminal procedure based on perception?”


After all the events we had experienced, this is a question, which is difficult to answer and will crush everyone in this country who has a conscience.


How will we get out…?


Knowing, finding, seeing is not enough.


A democratic willpower, which will keep the law system standing, is necessary.


We are not advancing with; fake heroes, Susurluk actors, the Dink’s murder’s side figures, acquitted coup supporters, innocent soldiers that are declared as coup supporters,  defendants who are victims, rustic rulership, the Gülen-led group that cuts fines and conducts liquidation, the judiciary that got out of hand, unreliable police; but rather we are sinking in the mire each passing day.


A sanction process of a great transformation wave, which had been mishandled….


Now, this state became a blockage.


Even when the Constitution Court unlocked some deadlocks around the right of individual communication, it’s still not enough to pave the way. The Gülen-led group’s moves other than December 17 – 25 attempts, like the situation related with the Balyoz case or the forged documents of Şık, Şener and Avcı, cannot become a matter of criminal investigation. Nobody is pursuing the evidences related with the people who had mobilized this system. AK Party is not openly questioning or discussing the days when they acted together with the Gülen-led group. Within a democratic course of action, the liquidation of the Gülen-led group, the establishment of the merit-based judiciary, and a great political and restoration move cannot be made.


In this deficiency, initially the political rulership and following them, the opposition, which instrumentalizes the issues, and everyone has a responsibility.


I can’t remember how many articles had been written about Hanefi Avcı in this column.


Avcı became the prominent symbols of victims of these problematic cleaning moves, which are partly right and partly bent.


He was pushed towards a trap after he stated that he had seen the Gülen-led group. He had been arrested and become a prisoner. He had been released with a revision of the Constitution Court.


As luck would have it, the famous reinforced ninth Department of the Supreme Court had confirmed the 10-year prison sentence of Avcı in the “Revolutionist Headquarters” case, because of not returning his licensed weapon in the state-of-emergency region.


The following is the news on the internet:


“In the Revolutionist Headquarter Organization Case, the 9th Department of the Supreme Court had approved the 5 year 7 months 15 days prison sentence, which had been given because of “Aiding the illegally armed Revolutionist Headquarter terrorist organization and their members” accusation of Hanefi Avcı, the ex-chief of Police. However, the 5-year sentence given to Avcı, because of the “possessing and carrying an un-licensed fully-automatic and semi-automatic gun” accusation, had been corrected and approved.


We are right at where we had started…


Avcı was saying the following on the phone yesterday:


“We were expecting this. This department of the Supreme Court is under control of certain people, and they continue making the same decisions. These types of decisions are actually pointing at their existence and effectiveness. They are reversing my complaint and giving the verdict; can you believe that? I had filed a complaint saying, “I’m being wiretapped within this frame” and made a warning; however, they turned this application into a crime of violating the secrecy of the investigation, and they deduce that I’ve done that because of being a member of the organization, and sentencing me to prison. Also, the other matter is the licensed weapon issue. They had sentenced me for not returning my licensed weapon, which they had found in my house and which is left from my days on duty at the state-of-emergency region….”


There is more: It seems that even the Revolutionist Headquarters organization had been made up in order to arrest Avcı….


There are juridical ways in front of Avcı. Asking for a decision revision, asking for the sentence to be postponed, applying to the Constitutional Court within the frame of civil rights: these are among the juridical ways for Avcı….


In any case, Avcı will not return to prison and there will be a solution for his imprisonment within the borders of a state of law.


However, we cannot advance in this way.


Gangrene cannot be treated with medical dressings.


All the parties, which have a group in the Parliament, should urgently bring the democratic course of action against this “organization” in to the agenda. If needed, legislation should be made to re-handle these sinister cases. The merit essentials should be reinforced in the assignments of the judges. The writers of this country should stop introducing every move against this organization as a wave of authoritarianism.


Otherwise, it means that the judiciary and the country are in trouble.


Otherwise, it means that this chaos will produce disengagement.
